Death & Donation Duties

Death duties are only payable on the deceased's estate held in Malta. The duties payable on the death of the testator are 5% of the estate. There is no succession duty between spouses, until the surviving spouse still resides in the same property.

In the case of a donation, the stamp duty payable is 5% of the value of the donation of the immovable and there is no duty imposed on the transfer of movables.
